Car accidents, in short

Car Accident: what you need to know

Car accidents on Canberra's roads cause injuries from whiplash and back injuries to fractures and brain injuries. After a crash you have to deal with medical appointments, time off work and an insurer, often all at once.

The ACT motor accident scheme pays defined benefits such as treatment and income replacement, generally regardless of who was at fault. If another driver caused the accident and your injuries are serious, you may also have a common law claim for a lump sum.

How we help after a car accident

  • Lodging your application for benefits on time
  • Making sure your income replacement is calculated correctly
  • Getting treatment approved
  • Challenging insurer decisions
  • Assessing whether you have a common law claim
  • Negotiating your lump sum settlement

After a car accident in the ACT

Since February 2020, car accident injuries in the ACT are covered by the Motor Accident Injuries (MAI) scheme. Most injured people can claim defined benefits for treatment and lost income, whoever was at fault, for up to five years.

If you were not mostly at fault and your injuries are serious enough, you may also make a common law claim for a lump sum. The thresholds are strict, and the decisions you make in the first months can affect your options later, so early advice helps.

What you can claim after an accident

Under the ACT Motor Accident Injuries Act 2019 you can claim defined benefits such as treatment and care, and income replacement while you cannot work, generally whoever was at fault. If someone else was at fault and your injuries are serious, you may also be able to make a common law claim for a lump sum.

Evidence that helps your claim

You do not need to have everything before you call us, but these records make a motor accident claim stronger. Keep copies of anything you have:

  • The police report number
  • Photos of the scene, vehicles and your injuries
  • Details of the other driver and their insurer
  • Medical records and treatment receipts
  • Payslips showing lost income

How much could a car accidents claim be worth?

Every claim is different. The amount depends on how serious your injuries are, whether you meet the thresholds for a common law claim, your lost and future earnings, and who was at fault. We give you an honest estimate once we understand your situation, and we prepare every claim to get its full value rather than settling early.

Car accidents: FAQs

I was a passenger. Can I claim?
Yes. Passengers can claim under the ACT scheme, and usually have a common law claim if a driver was at fault, even if that driver is a friend or family member. The claim is against the insurer, not the person.
The accident was partly my fault. Can I still claim?
You can usually still claim defined benefits. For a common law claim, your share of fault may reduce your damages, but it does not always rule them out.
Should I accept the insurer's first offer?
Get advice first. Early offers may not reflect your future treatment needs or lost earnings. Once you settle, you usually cannot reopen the claim.
Do I need to report the accident to police?
You should report an accident involving injury to police. A police report is often needed for your claim.
How much does a motor accident lawyer cost?
We run these claims on a No Win, No Fee basis. Your first conversation is free, there are no upfront fees, and if your claim is not successful you do not pay our professional fees. You get a written costs agreement before we start.
Is there a time limit?
Strict deadlines apply under the ACT scheme for lodging an application for benefits and for common law claims, so get advice early.
