Landlord negligence, in short
Landlords must keep rental properties safe. If you were injured because a landlord or agent ignored a dangerous defect, you may be able to claim. United Legal is a Canberra firm based in Fyshwick. We work on a No Win, No Fee basis and your first conversation is free.
Landlord Negligence Injury: what you need to know
Tenants and their visitors are injured by broken stairs and balconies, rotten decking, faulty electrical wiring, loose handrails and other defects that should have been repaired.
If you reported the problem and it was not fixed, that is strong evidence for your claim. Keep copies of your repair requests and any replies from the landlord or agent.
Rental property hazards
- Broken or rotten stairs, decks and balconies
- Loose or missing handrails
- Faulty wiring and electrical hazards
- Mould causing illness
- Poor lighting in common areas
- Hazards in apartment common property
When rental property defects cause injury
Landlords and property managers must keep rental properties reasonably safe and repair known defects. Broken stairs, faulty balconies, electrical problems, mould and gas leaks can cause serious injuries.
Written repair requests are strong evidence. If you told the landlord or agent about a problem and it was not fixed, keep those emails and messages.
What you can claim
If a business, landlord, council or other occupier failed to take reasonable care and you were hurt, you may be able to claim under the Civil Law (Wrongs) Act 2002 (ACT) for pain and suffering, lost income, medical costs and care and assistance.

Evidence that helps your claim
You do not need to have everything before you call us, but these records make a public liability claim stronger. Keep copies of anything you have:
- Photos of the hazard and where it happened
- An incident report from the business or owner
- Names and numbers of witnesses
- A request to keep CCTV footage
- Medical records and receipts
How much could a landlord negligence claim be worth?
Every claim is different. The amount depends on how serious your injuries are, your lost and future earnings, your medical costs, the care you need, and whether you share any of the blame. We give you an honest estimate once we understand your situation, and we prepare every claim to get its full value rather than settling early.
