School Injury Claims: what you need to know

Children are injured at school from falls on playground equipment, poorly supervised activities, sports injuries, and bullying or assaults that staff should have prevented.

Not every school injury is a claim. A claim usually depends on whether the school failed to provide reasonable supervision or safe premises. We give you honest advice about whether it is worth pursuing.

School injuries we help with

  • Playground falls
  • Inadequate supervision
  • Sports and PE injuries
  • Injuries on excursions and camps
  • Bullying and assaults
  • Unsafe buildings and grounds

Injuries at school

Schools must provide reasonable supervision and safe facilities. Students are injured in playgrounds, sports, science classes, excursions and through bullying. The school's duty is high because it is caring for children.

Claims can be made against public and private schools. Records of incident reports, supervision rosters and previous complaints can all be important.

What you can claim

If a business, landlord, council or other occupier failed to take reasonable care and you were hurt, you may be able to claim under the Civil Law (Wrongs) Act 2002 (ACT) for pain and suffering, lost income, medical costs and care and assistance.

Evidence that helps your claim

You do not need to have everything before you call us, but these records make a public liability claim stronger. Keep copies of anything you have:

  • Photos of the hazard and where it happened
  • An incident report from the business or owner
  • Names and numbers of witnesses
  • A request to keep CCTV footage
  • Medical records and receipts

How much could a school injuries claim be worth?

Every claim is different. The amount depends on how serious your injuries are, your lost and future earnings, your medical costs, the care you need, and whether you share any of the blame. We give you an honest estimate once we understand your situation, and we prepare every claim to get its full value rather than settling early.

What to do now

  1. Report the incident to the business or owner and ask for it to be recorded.
  2. Take photos of the hazard and your injuries, and get witness details.
  3. Ask for any CCTV to be kept, as it is often overwritten within days.
  4. See a doctor and keep receipts for your costs.

School injuries: FAQs

Can I claim for my child's injury at school?
Possibly, if the school failed to take reasonable care and that caused the injury. We look at what happened and whether supervision or safety fell short.
Does it matter if it was a public or private school?
Both can be responsible. The claim is usually against the school's operator, which may be the ACT Government or the school itself.
Can I claim for my child's bullying injury?
Possibly, if the school knew or should have known about the bullying and failed to act reasonably, and your child suffered a recognised injury.
Can teachers or staff claim?
Staff injured at work usually claim workers compensation instead. See our workers compensation pages.
How much does a public liability lawyer cost?
We run these claims on a No Win, No Fee basis. Your first conversation is free, there are no upfront fees, and if your claim is not successful you do not pay our professional fees. You get a written costs agreement before we start.
Is there a time limit?
The general time limit in the ACT is three years, and you must give notice of your claim early. Get advice as soon as you can.
